
Benview Cottage Terms
Contract
The rental contract is between Cruickshanks Arran (‘the Owner’) and the paying client (‘the Guest’).
Occupancy
Benview Cottage can accommodate a maximum of 2 people. We do not accept children or babies. Bookings can only be made by a person over the age of 18.
Period of Let
This is normally on a weekly basis Friday to Friday however weekend and short periods may be available outside of peak season.
Arrival and Departure
Check-in is from 4pm on the day of arrival and check out is by 10am on the day of departure, to allow us to prepare the property between guests. We ask all Guests to leave the house in a clean and tidy condition.

We operate on a self-check in basis in case we are not around when you arrive, and access instructions will be sent to the email provided at booking prior to your stay.
Exclusion of the Rent Act
The property is let for the period agreed for holiday purposes only and will not exceed 4 continuous weeks. The contract effected on confirmation of reservation relates to a holiday let only and is therefore not an assured tenancy in terms of Housing (Scotland) Act 1988. This confers on the client the right to occupy the property for the period agreed for holiday purposes only, in terms of Schedule 4 of the aforementioned Act.
Deposit and Balance
To confirm the booking, a 35% non-refundable deposit is payable at the time of booking. The remaining balance with any additional charges will be required 9 weeks prior to the arrival date. A reminder email will be sent to you requesting the balance due. If your balance is not paid in advance, we reserve the right to cancel your booking.

If a booking is made within 9 weeks of the arrival date, 100% of the payment will be required at the time of booking.
Payment Method
We accept Visa Credit, Mastercard, Visa Debit, Maestro and American Express. Online payments are processed through a secure third-party platform, Stripe. If preferred, a BACS transfer can be made; please get in touch with us to arrange this.
Bookings Management
Bookings are handled by a secure third-party bookings-management system, Freetobook.
Pets
Dogs are welcome in Benview Cottage, a maximum restricted to 2 well behaved dogs. At the time of booking please let us know how many dogs and what breed they are. We do not accept any other type of pet. There will be a charge of £25 per dog per stay which will be added at time of booking.

Dogs must be healthy, fully house trained and kept under control at all times. We will provide dog bowls and a dog towel for the duration of the stay however your pet may be happier if you bring their own pet bed and food bowls.
We do ask that you are respectful. Please keep dogs out of the bedroom and off all the furniture and try to avoid bringing mud and dirt into the house. Any hair should be cleaned up before departure. Dogs should not be left unattended or allowed to disturb neighbours or nearby animals.

We kindly ask that all Guests pick up after their dogs both inside and outside to keep the area clean and pleasant for everyone.

The garden is fully enclosed, but please supervise your dog when outside. Dogs must not be allowed to bark excessively, escape the property or disturb neighbouring homes. Dog owners must ensure that their pets are free from parasites and fleas; failure to do so may incur subsequent charges.
Young dogs (e.g. puppies less than 6 months’ old) must be declared to us at the time of booking and authorised by us.
You will be liable for any damage caused by your dog(s). Any damage is to be reported immediately. Any additional cleaning required, that may incur an additional charge, will be at Owner’s discretion.
Damage Deposit
A Good Housekeeping Deposit of £200 will be taken when the balance of the rental is due and then, providing no damage or breach of letting conditions is reported, will be refunded 5 days after the end of your stay. The property and its contents are checked prior to your arrival to make sure there is no damage and that everything is in good working order. Please treat the property and its contents with due care and respect so that other guests may continue to enjoy them. We ask all Guests to leave the property in a clean and tidy condition.
Please us let us know about any damages/breakages as soon as possible, especially before check-out, so we can replace items in good time for the next guests.
Damages may be charged to your booking card if:

damage was done to the property or contents other than normal wear and tear

the property requires special cleaning
-
items were removed from the property
-
there was smoking or vaping inside the property
-
any other relevant charges and costs incurred by the owners on behalf of the Guests.
For the avoidance of doubt, in the event that the cost of damage is in excess of the deposit, you shall be liable to us for any such excess in addition to our right to retain the deposit. If damage occurs and we must cancel and/or refund subsequent bookings, we may bring a claim against you for any loss arising as a result.
Cancellation Policy
Cancellation by Customer
Please telephone us immediately if you have to cancel and on the same day send us written confirmation, by email or post, quoting your booking reference number. Your cancellation is effective from the date we receive your written confirmation by email or post; and, once received, we will confirm the cancellation.
If you cancel more than 9 weeks prior to the arrival date, we will endeavour to re-let the property for the period of hire. If successful in doing so, the deposit will be refunded less an administration fee of £40. If we are unable to re-let the property, the deposit will be non-refundable.
If cancellation occurs within 9 weeks of the arrival date, then the deposit will be non-refundable, and the full balance will be due.
If any outstanding payments are not made prior to 9 weeks of the arrival date, we shall be entitled to treat your booking as cancelled; and any booking fees paid will be forfeited, and any outstanding payments will be due.
Cancellation by Owner
We reserve the right to makes changes to or cancel a booking even after the booking has been confirmed. In the unlikely event that we must cancel, you will be entitled to a full refund of the accommodation costs. Notification will be given of the cancellation as soon as possible, in writing, and we will promptly refund all payments made to us for your holiday. Our liability for cancellation will be limited to payments made to us; no additional compensation, expenses or costs will be payable.
Services Included
The following is included in your booking: electricity, heating, Wi-Fi, Smart TV with Freesat, bed linen, towels, toiletries, an initial supply of firewood and a welcome pack.
Electric Vehicle Charging
We have an EV charger at the property, and all EV charging must be done with the dedicated Zappi charger provided using a manufacturer approved cable and is for the exclusive use of our Guests. Please do not plug into the Cottage electrics for electric car charging, this is strictly prohibited and could void the insurance of the property. If you will require use of the charging port we ask that you inform us before your stay. Our charges are based on the current pence per kilowatt hours (kWh).
Insurance and Travel Disruption
We strongly advise that you take out comprehensive holiday and travel insurance including cover for cancellation. Cancellation extends to the ferry service being made unavailable for any reason (or any other travel to the property which is disrupted or cancelled). If you choose not to, then you accept responsibility for any loss that you may incur due to cancellation.
Force Majeure
We will not be liable for any breach of the contract arising as a result of any event which is beyond our control. Such events may include (but are not limited to): war or threat of war; terrorist activity or threat of terrorist activity; industrial disputes; epidemic, pandemic, closure of ports or airports, collapse of buildings, fire, explosion or accident; traffic or road conditions or road closures; technical or mechanical breakdown; adverse weather conditions; natural disasters and all similar events or circumstances.
No Smoking/Vaping
Smoking or vaping is not permitted inside the property. If smoking outdoors, then please ensure that cigarettes are properly extinguished and disposed of carefully in the bucket provided. We reserve the right to charge for any additional cleaning that may be required.
Candles
Owing to the high fire risk, candles are not allowed in the property.
Lost Property
We are happy to return found items where possible. Please note we will send you a payment link to cover the cost of postage and packaging.
Liability
We accept no liability for any death, personal injury, loss or damage of Guest’s personal property while staying in the property. The use of the property and contents is entirely at the Guest’s risk. All Guests are recommended to ensure they have adequate property and personal accident insurance for their holiday.
Restrictions on Hire
We reserve the right to refuse to hand over the accommodation to anyone who, in our opinion, is not suitable to take charge of the property. In any such case all accommodation costs paid to us shall be refunded and the contract terminated without further liability.
We reserve the right to terminate the contract at any time and remove any person or persons due to improper use, unreasonable behaviour, damage to property, causing or likely to cause annoyance or offence to neighbours, or any other breach of these Terms & Conditions, without any refund being due or compensation being payable.
Right of Entry
We reserve the right of entry to the property at any reasonable time for maintenance, repairs or inspection. We will contact you if this is required during your stay.
Complaints
Every effort is made to ensure that you have an enjoyable stay. However, if you have any complaints or concerns, it is essential that you contact us immediately so we can work to seek a resolution as quickly as possible. Complaints received after your holiday will not be accepted if we have not had prior notification and therefore the opportunity to put matters right during your stay
Data Protection
We are committed to protecting your privacy in accordance with the Data Protection Act 1998. Any data gathered during the course of a booking may be held on computer. We would like to hold this data after your visit to be able to inform you of future offers. If you would prefer us not to hold this information please let us know.
